* A power of attorney (POA) is a written authorization to represent or act on another’s behalf in private affairs, business or some other legal matter. The person authorizing the other to act is the “principal, grantor or donor” (of the power). The one authorized to act is the “agent”.
From the Attorney General of Ontario’s website:
- Many people believe their families will be able to step in if something happens and they cannot make decisions for themselves. This isn’t always true.
- You can name someone to make financial decisions for you, such as paying your bills, with a continuing power of attorney for property.
- For personal care and health decisions such as where you live, what you eat or what medical care you will receive if you get sick or injured, you can name someone in a power of attorney for personal care.
- Tip: No one can make you sign a power of attorney if you don’t want to. But, if you don’t choose one, the government may have to appoint someone to make certain decisions for you. It’s better if you choose someone you feel you can really trust and who knows your wishes.

You have been appointed Trustee of an estate, and have the incredibly daunting task of closing any and all aspects of a deceased person’s estate. Responsibilities include probating any Will (or an Application to become Trustee if there is no Will), paying off all debts, closing all accounts, Ontario Estate Administration Tax, obtaining appropriate certificates, filing final income tax returns, setting up any Trust required under the terms of the Will, and disbursements to beneficiaries. There are a number of other tasks that need to be completed, and oftentimes this takes the better part of 12 – 18 months for final closure. We can offer much-needed support, guidance, and direction to ensure no task is left undone or overlooked. It is often beneficial to have objective support through these somewhat tumultuous, oftentimes emotional decisions.
